ReplyDeleteYes, there are plenty automobiles to torch over here - but this little fact has hardly anything to do with the CCR (which is American) who wants to take Rumsfeld to court in Germany!?
ReplyDeleteThey tried in 2004 and failed - since Rumsfeld lost his immunity and Germany having a new Federal Proscecutor they hope to get the law suit through this time. They will bring it to action on Tuesday and then the Federal Proscecutor will decide if it's going to be taken further. The defending lawyer is Wolfgang Kaleck.
That's the situation so far. Germany has a court which deals with worldwide war crime, so in a way anybody can file a law suit - if you like it or not. But that's democracy as well. One can always discuss about if it makes sense taking Rumsfeld to court or not, but I think losing reality isn't the point.
Burning cars??? Heck....if you think a German will have its automobile torched, you are darn wrong - and furthermore this has nothing to do with the US bases too.
Correct me, if I am wrong, but I have the slight impression you are just waiting for burning cars here at my end, so you can bash my country as you bash France.
Sorry, this is a kind of transcontinental 'friendship' I can truly do without.

Very glad for your insight into this situation. I have no desire to "trash" Germany. I just clearly am not informed regarding the German courts. I would like to see us as strong allies with Germany and I don't want to see Germany go the way of France in its Islamification. Hope that is not the case there in Germany.

ReplyDeleteNo, it's not an American court...it's an organisation called 'Center for Constitutional Rights' and they are filing this law suit together with the FIDH (International Federation for Human Rights). I actually didn't know before that those kind of law suits are possible here in Germany, but apparently there's some court which deals with that kind of stuff. I remember when they tried this in 2004, but there wasn't a huge media hype about it, as lots of people thought it's kind of ridiculous.
ReplyDeleteMade a mistake though - not the Federal Proscecutor decides if the action will be taken further, it's the judge. So I guess in a few days we all know more.
So that's all I know - they are doing this in behalf of twelve torture victums, 11 from Abu Graib (spelling?) and one from Guantanamo.
Anyway, I know that many of you hold Rumsfeld in high regard - but no matter what, wasn't it kind of predicatble that something like this is going to happen after the elections?
Personally I am not that fond of Rumsfeld, but I think he should enjoy his retirement now actually; anything concerning law suits will be a bottomless dwell actually. I mean - what will be next? Dragging European politicians to court as well because they kept quiet of certain things etc., etc. - in the end it will do more damage than any good. The terrorists have been successful indeed - our world got more insecure and when the western world keeps kicking itselfs in the butt, they'll be even more happy.
Got something which might interest you: some days ago I listened to the radio and a lawyer from Nordrhine Westphalia said they cannot make sharia illegal, because sharia is not a law itself, therefore the German law cannot do anything about what has no jurisdiction.....Nope, this isn't an Aprils joke!!!
So far no sharia-mad-hatter has come up yet, but if they do apparently our law will be helpless as a paragraph for sharia is missing......

I didn't have a closer look at their site yet, from a first glance I have the impression that they are law suit crazy, but I might be mistaken.
If you want I keep you updated about what the German press says about the possible trial; personally I'm quite curious about this German lawyer!
No torture at Guantanamo. The terrorists are taught to whine like babies and say how bad we are, etc. They know the western liberal and the ACLU are weak. Of course, we have interesting times ahead.

The Federal Lawyer Monika Harms received a 220 pages long statement of claim (lots of reading she has to do!). It's against Rumsfeld, George Tenet, Ricardo Sanchez and 8 more person - the claim is that these people have ordered war crimes, supported them or haven't done anything about it. So if this gets through it will take a long time indeed.
ReplyDeleteThe reason why it's done in Germany is because it's the last 'hope' as the US do not acknowledge the International Court of Justice in Den Haag, courts in Iraq don't have a mandate to sue US politicians plus that German investigators can act about everywhere when it comes down to war crimes.
The lawyer Wolfgang Kaleck did the law suit in 2004 as well.
Nevertheless - if this is going to be accepted by the court it will take a darn long time!!! And it wouldn't surprise me if the outcome is somewhat below zero, mainly because it will be political - and politically seen it's not very wise!
